Terms of Use

These Terms of Use ("Terms") govern your access to and use of the CryptoMEX platform ("Service"), operated by CuiveMedia – Dienstleistungen, Inh: Brian Brelöer, Siriusstraße 2, 12524 Berlin, Germany ("we", "us", "Operator").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

CryptoMEX is a trading interface and analytics platform that connects to third-party cryptocurrency exchanges via user-provided API keys. The Service provides:

• A unified dashboard for viewing positions, orders, and balances across multiple exchanges.
• Order placement functionality relayed to connected exchanges.
• PnL analytics and trade history aggregation.
• Market data, signals, and analytics panels.

CryptoMEX is not a cryptocurrency exchange, broker, custodian, or financial advisor. We do not hold, custody, or control any of your funds at any time.

Nothing on this platform constitutes financial, investment, trading, tax, or legal advice. All information provided through CryptoMEX — including but not limited to trading signals, analytics, sentiment data, whale tracking, liquidation data, leaderboard rankings, and PnL statistics — is for informational purposes only.

You acknowledge that cryptocurrency trading involves substantial risk of loss and is not suitable for every person. Past performance displayed on the platform (including leaderboard rankings and PnL data) is not indicative of future results. You are solely responsible for your own trading decisions.

To the maximum extent permitted by applicable law, the Operator, its owner, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Financial losses resulting from trades placed through the Service.
• Losses caused by exchange API downtime, latency, or errors.
• Losses caused by incorrect, delayed, or missing market data.
• Losses resulting from unauthorized access to your account due to compromised credentials on your end.
• Losses caused by exchange insolvency, hacks, or regulatory actions.
• Losses arising from reliance on signals, analytics, sentiment data, or any other information displayed on the platform.
• Damages resulting from bugs, errors, or interruptions in the Service.
• Any indirect or consequential damages, including loss of profit, data, or opportunity.

In no event shall our total aggregate liability exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or EUR 100, whichever is greater.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Market data, prices, or analytics will be accurate or complete.
• Orders will be executed correctly or at the expected price by the underlying exchange.
• The Service will meet your specific requirements or expectations.

You agree to:

• Provide accurate registration information and keep your account credentials secure.
• Only connect API keys with appropriate permissions (we strongly recommend disabling withdrawal permissions).
• Comply with the terms of service of each exchange you connect.
• Comply with all applicable laws and regulations in your jurisdiction, including tax obligations.
• Not use the Service for any illegal purpose, including money laundering or market manipulation.
• Not attempt to reverse-engineer, scrape, or interfere with the Service.

You are solely responsible for determining whether cryptocurrency trading is legal in your jurisdiction and for complying with all applicable regulations.

You grant us permission to use your exchange API keys solely to perform actions you request through the Service (viewing data, placing orders, retrieving history). Your API keys are encrypted at rest and decrypted only in memory at the time of use.

We are not responsible for any actions taken by the exchanges themselves, including but not limited to order execution, liquidations, margin calls, account restrictions, or exchange outages.

Paid plans are billed through Stripe. By subscribing, you agree to Stripe's terms of service. Subscriptions renew automatically unless cancelled before the end of the billing period.

We reserve the right to change pricing with 30 days' notice. Price changes do not affect the current billing period.

Refunds are handled on a case-by-case basis. We are not obligated to provide refunds for partial billing periods or for losses incurred while using the Service.

You agree to indemnify, defend, and hold harmless the Operator and its owner, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service.
• Your violation of these Terms.
• Your trading activities and resulting financial outcomes.
• Your violation of any third-party rights or applicable laws.

All content, design, code, and branding of CryptoMEX are the property of CuiveMedia. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

Screenshots and preview images on this platform are protected and may not be downloaded, redistributed, or used without permission.

We reserve the right to suspend or terminate your account at any time, with or without cause, including but not limited to violation of these Terms, suspected fraud, or extended inactivity. Upon termination, your API keys will be deleted and access to the Service revoked.

You may delete your account at any time by contacting us at help@cryptomex.de.

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, power outages, internet disruptions, exchange outages, regulatory changes, or government actions.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
